Standard Warranty

The difference between our painting company and most of the others around the valley is the fact that we stand by our work – both Material AND Labor.

We develop great loyalty, and we teach, train and coach each employee for craftsmanship and professionalism. We are certain that our workmanship is worthy of a written warranty.

Many contractors speak of warranty in terms of Material only (read the fine print), to the extent the paint manufacturer admits to product failure. But that concept can exclude the possibility of contractor error in the first place. ALL licensed contractors must warranty workmanship for a minimum of 2 years, but MTS confidently matches it’s Material warranty too.

General Warranty Particulars

We offer our standard seven-year (7) labor and material warranty for painting from the date of substantial completion. MTS Painting will apply coatings that are uniform in appearance, color, texture, hiding and sheen. The coatings applied will also be free of foreign material, lumps, skins, runs, sags, holidays, misses, or insufficient coverage. It is also a surface free of drips, spatters, spills, or overspray caused by painting contractor’s workforce. A conditional warranty against peeling, blistering, and extreme fading is implied on these newly applied coatings.

 

Our standard seven-year (7) labor and material warranty may vary depending on the services provided and is standard on painting if we are allowed to use our typical recommended materials. The warranty terms are written within our contracts, so the duration of the warranty will always be clear. The number of years offered depends on the task and conditions but most importantly, which products and processes you have contracted for. Pre-existing damages or uncontrollable conditions are also factors in warranty terms. The warranty goes into effect immediately after payment in full and ends after the contracted term of warranty, as specified in your contract, from the date of substantial completion. If no date is specified, the default date is 2 years on materials and 5 years on workmanship (labor).

Exterior Painting Warranty Particulars

Exterior clear varnishes/polyurethanes and exterior wood preservative stains (deck stain) are always limited to a 1-year warranty unless specifically noted. Warranty excludes damages caused by consistent moisture intrusion (sprinklers, roof leaks, and below-grade walls) and unstable substrates (previous coatings, internal rusting, rotting wood, delaminating stucco, and structural movement).

Warranty Limitations

Our warranty is associated with the structure, not the homeowner. It may be transferred (only once) to any future legal owner[s] at any time. As your warranty provider, all warranty work is to be performed by MTS Painting. All warranty requests are accepted from the homeowner/owners only. No renter or anyone other than the homeowner may submit a claim. An authorized agent may be assigned by the owner to negotiate and perform inspections of the warrantied work.

 

Our warranties cover all aspects of the work that we complete. We are not responsible for claims that were further affected due to negligence of a timely claim submission. This warranty does not cover the expenses of additional contractors or services. MTS Painting only covers materials and labor costs involved with the completion of the warranty work. Any and all additional materials needed to successfully complete warranted work will be charged to the current homeowner.

Voided Warranty Conditions and Parameters

MTS Painting has the right to void any warranties at any time. Under these conditions we have the right to terminate the warranty immediately; including but not limited to:

  • Clear evidence of abuse, damage, or neglect to the home (intentional or accidental) that doesn’t clearly reflect a lack of correct craftsmanship.
  • Abrasion, mechanical damage, abrasive cleaning, or other damage resulting from the use of chemicals/cleaning agents, exposure to harmful solids/ liquids or gases.
  • Work done by others including the homeowner or their agent.
  • Maintenance of coatings is not performed properly.

This warranty does not cover:

  • Normal color fading, loss of sheen, or minor chalking caused by exposure to sunlight, wind, or water.
  • For most paint manufacturers, the general allowable standard of fading is 10 percent per year. Certain high performance and more expensive products will do much better than others, so always consider an upgraded or premium product for better duration. It is normally cost-effective to upgrade in the long run due to the major cost of a paintjob being the labor cost.
  • Cracking, blistering, chipping, or peeling caused by structural expansion and contraction, settling, or other movement of building components.
  • Paint degradation or discoloration due to mold or mildew.

 

Warranties do not cover any natural disaster, extreme storms, or flooding. The warranty doesn’t cover areas that are remotely already damaged, subject to standing water, areas of high moisture intrusion, extreme weather conditions, or any conditions that are outside the manufacturer’s label warranty.

The Warranty is Only Valid Under These Conditions

The total invoiced price is fully compensated.

 

The property is conveniently accessible to MTS’s employees, or subcontractors, or manufacturer’s representative to conduct any warranty work or inspections.

Warranty Specifics

Any repairs covered under this limited warranty will be performed only on specific areas and to the level of surface preparations originally described in the preparation section of the contract. We will conduct warranty work within 30 days after your warranty request. All workmanship warranties cover overlooked or unfinished areas. Warranties also cover any accidental/incorrect installations or applications. (Only if there is clearly a better way of installation that is not related to cosmetic issues, will we honor the service request. And only if we were originally contracted to complete the task). Any cracks in drywall, plaster, stucco, wood, siding, or other like surfaces are not warranted unless we were contracted to fix the area. This limited warranty does not cover conditions where the color or finish has been affected or fades over time. Extreme short-term fading is covered.
 
Our warranty only covers the work that we have completed. It does not protect you from future issues that come with maintaining your home or any manufacturer’s claim or lawsuit. The warranty does not cover any manufacturer’s defects with materials supplied by the customer or contractor. Maintenance per manufacturer’s instructions must be performed for warranties to be valid.
 
This warranty offers you only specific legal rights. Some jurisdictions do not allow limitations on how long an implied warranty lasts. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. This warranty is not valid for any of these areas and may not be altered or extended for any reason unless it has been agreed upon, in writing, by MTS Painting. In no way shall the contractor/individuals be held liable for incidental or consequential damages. We will not conduct any warranty work that will potentially exceed the original contracted price; however, we do take full responsibility for any items damaged on our behalf. Discounts and coupons may not be used in association with any warranty work, at any time, for any reason.
 
For all warranty requests, first contact the estimator or project manager to discuss issues and to schedule an inspection of your property. Second, contact the Business Manager and then President if reasonable satisfaction is not reached. All elevated claims must be conducted in writing to MTS Painting through email or letter with: Invoice Number, Name, Address, and Contact Info.

Disparities

While our focus is on quality, service and compliance to industry standards, there may be occasions of disparity or disagreement between our company and our valued customers. In such situations, we rely on professional organizations, industry boards, state agencies, and other resources to resolve outstanding issues as expeditiously as possible.
 
Suggested arbitration services include: PCA Technical Help Line, Arizona Registrar of Contractors Building Confidence Inspection and/or claim system, BBB, local PCA experts, various manufacturers’ representatives (including the manufacturer used, but not limited to), other PCA contractors, paint inspectors and failure consultants, and NACE Inspectors.
 
We hope we never have to implement these warranty procedures or arbitration services, but we realize, (and hope you do, too) that we don’t live in a perfect world. Construction is not a perfect science, and our employees aren’t perfect human beings, but we do our best to mitigate these things and we always want to improve our processes for the next job. Language barriers, unknown expectations, and uncontrollable circumstance can be our enemies, so please be patient with us, we truly want all our customers to be fully satisfied.
